About the Program
Many healthcare and human resource professionals are concerned about effectively managing intermittent leave requests based on fears not being in compliance with the Family and Medical Leave Act (FMLA). FMLA has created a number of administrative challenges, including access to health information, case certification, assurance of fitness for duty and chronic condition management. Participants will learn legally accepted avenues for FMLA case management employing medical/scientific, evidence-driven approaches. Experts in the fields of law, occupational medicine and occupational health nursing will offer practical solutions and tips to reduce legal liability, maintain regulatory compliance and decrease unauthorized use of intermittent leave while ensuring the best health outcome for the employee. 

What You Will Learn
Upon completion of this program, the learner will be able to:

  • Discuss liability issues for occupational and environmental health nurses in the interpretation and navigation of medical leave legislation; 
  • Develop a medical compliance plan that addresses certification, periodic re-certification and return-to-work evaluations; and
  • Utilize tools for decision support and administration of FMLA requests.

About the Faculty
Tamara Y. Blow, RN, MSA,  COHN-S/CM, CBM
Ms. Blow is manager of occupational health services at Philip Morris U.S.A. where, as one of her responsibilities, she provides oversight for the company’s FMLA administration. Ms. Blow is in the process of writing her dissertation for a doctorate in organizational leadership at Nova Southeastern University. In the December 2007 edition of Occupational Health Management, she contributed to their advisory regarding practical solutions on FMLA administration. In addition, Tamara serves as director of the southeastern region of the American Association of Occupational Health Nurses, Inc. (AAOHN) and represented AAOHN at the U.S. Department of Labor’s FMLA Stakeholder Meeting held in September 2007. 

Rose M. Matricciani, RN, JD
Ms. Matricciani is partner at the law firm of Whiteford, Taylor & Preston, LLP in Baltimore, Md. where she represents healthcare providers concerning compliance with laws and regulations that affect their practice. In addition to her law practice, Ms. Matricciani has presented on the topics of nursing licensure, malpractice, electronic healthcare transactions and medical records privacy issues for various professional organizations.  

Howard M. Sandler, MD
Dr. Sandler is a physician specializing in occupational and environmental medicine. He is the president of Sandler Occupational Medicine Associates, Inc., which medically manages work related cases and programs for its many clients in addition to other occupational health, hygiene and safety services.  He has served with NIOSH and consulted with OSHA and the Environmental Protection Agency along with a wide diversity of industry and governmental agencies. Dr. Sandler was invited to provide expert testimony at the recent U.S. Department of Labor’s Stakeholder Meeting on current FMLA regulations.
