The confidential treatment of health information and health records is a professional obligation of the occupational and environmental heath nurse to ensure public trust. The occupational and environmental health nurse is routinely involved in making judgments as to ethical, moral and legal implications concerning the protection of the privacy of the individuals under care. From the Family and Medical Leave Act (FMLA) to the various laws that pertain to the confidentiality of health information, such as the Health Information Portability and Accountability Act (HIPAA) and the Americans with Disabilities Act (ADA), the OHN is a resource to employers and employees in understanding their protections and obligations under the law.
